State Appeals Court approves class-action against Dow over dioxin damage

The Michigan Court of Appeals has approved class-action status for a lawsuit brought against the Dow Chemical Co. by residents of the dioxin-contaminated Titabawassee flood plain.

“We are happy about the ruling,” said Norm Siegel, attorney for the plaintiffs.

Siegel said the class will include about 2,000 people who seek damages associated with the contamination of their homes and properties in the Midland-Saginaw area.  Representatives from Dow said they are studying the court’s decision, which was handed down on Thursday.

Dioxin is a highly toxic byproduct of the chemical manufacturing process.

Earlier this month the U.S. Environmental Protection Agency’s Superfund Division called off clean-up negotiations with Dow and criticized the company for failing to offer a dioxin clean-up plan that would protect human health.
