ACLU warns Pontiac EM has jeopardized election

By Eartha Jane Melzer | 11.07.11 | 9:45 am

Pontiac Emergency Manager Lou Schimmel’s decision to fire the city clerk last week puts the integrity of tomorrow’s election in question, according to the American Civil Liberties Union of Michigan.

The Detroit News reports that the ACLU told Schimmel that installing Deputy Emergency Manager Joe Sabota as clerk is inappropriate because he is unfamiliar with Pontiac elections and doesn’t have adequate election administration experience.

“Although the Oakland County Clerk’s office will reportedly assist by taking over some of the duties performed by the Pontiac City Clerk, it is unclear which office is ultimately in charge of the upcoming election and any division of responsibilities between the two offices,” the ACLU letter says.

“The ACLU along with many other organizations and individuals throughout the state has expressed concern that Public Act 4 and the expanded powers granted to Emergency Managers subvert the democratic process. The dismissal of the Pontiac City Clerk less than two weeks before an election, with little to no detail regarding plans to ensure proper election administration, only validates these concerns.”

In addition to firing the city clerk Schimmel, has fired the city attorney and hired United Water to take over the Dept. of Public Works.
