Appeals court blocks medical marijuana sales between patients

In the first appeals court ruling on commercial sales of medical marijuana, a three judge panel has ruled that Michigan’s 2008 medical marijuana law does not allow patients to sell to each other.

The Detroit News reports that the court said the Compassionate Apothecary in Mount Pleasant can be shut down as a “public nuisance.”

Compassionate Apothecary allows certain people to sell marijuana to each other, with the owners taking as much as a 20 percent cut. In less than three months, the business earned $21,000 before expenses after opening in May 2010.

Authorities went to court to shut down the business, but a judge refused, saying the medical marijuana law allowed the transfer of pot from patient to patient.

Compassionate Apothecary has 345 members. They are certified by the state to use marijuana to alleviate pain or other medical problems, or they are registered caregivers for patients. They can rent marijuana lockers for $50 a month.

Medical marijuana dispensaries across the state are studying the ruling.

The Michigan Supreme Court has agreed to hear cases on other aspects of the medical marijuana law.

    I would think that logic would prevail and common sense would have dictated this outcome a long time ago.  I am not for banning MJ, and do not use it.

    a very sticky wicket, this legislation…….better for all if public health representatives, substance abuse professionals, law enforcement, judiciary, academics had all been consulted before legislative actions had ever been taken…As Joubran once wrote, “Tis better to debate an issue without solving it, than to solve an issue without debating it”….wisdom, applicable to the current topic, is there-in contained….ndv

    Jaxdude…I appreciate honest differences of opinion …however, there are hundreds of intelligent and well-informed professionals (excluding my own ‘feined intelligence’)_ whose discontent over the law as drafted raises concern over its implementation and its effect on holders of “blue cards” who are not hired for safety sensitive jobs because of their use of marijuana..Federal Law and State laws are at odds and need be reconciled….through debate and ,where possible, concensus……’obsolete’ is probable a valid descriptor for one whose involvement in such matters goes back nearly 50 years…Your perception is right on…hopefully legitimate and not mean-spirited or reflective of demagoguery…..
