ACLU gets injunction in Genesee petition case

By Ed Brayton | 07.22.11 | 3:55 pm

The judge in the case filed by the ACLU against Genesee county over restrictions they put on the right of residents to distribute petitions at public parks has issued a preliminary injunction ordering the county to stop enforcing such rules pending the outcome of the case.

In a press release, ACLU legal director Michael Steinberg said:

“We are pleased that petitioners will now be able to exercise their free speech rights throughout the public parks of Genesee County without a permit. Hopefully, government officials throughout the state will follow the lead of Genesee County and recognize the right to petition and speak out on public issues in public parks and on public sidewalks is a cherished and time-honored American value.”

Issuing a preliminary injunction is not a final resolution of the case, but it strongly suggests that the judge thinks the plaintiffs are likely to win in the end.
