Benton Harbor emergency manager plans to rescind commission resolution

Benton Harbor’s emergency manager says he will issue an order rescinding a city commission resolution declaring the emergency financial manager law unconstitutional.

The city commission approved the resolution Monday night. The approval violated an earlier order of Emergency Financial Manager Joseph Harris which usurped the powers of the commission. The order allowed the city commission to vote on starting a meeting, closing a meeting and approving minutes of meeting.

Now Harris tells WSJM that he is going to rescind the resolution, which he says has no legal validity. While Harris says he won’t go so far as to lock the elected body from city hall, he does say he will be sending cease and desist orders to the commission members.

    Ignore this man.

    These EFM’s have no power if those they attempt to rule do not legitimize their claims of authority.

    You people did NOT vote for this this man, he was appointed to rule over you.

    Obey you’re city council.

    Treat Harris the same you would ignore any unruly little child throwing a tantrum.

    Where was the big over reaching government when the city was beginning to fail? Why did they not try to prop them up? I suppose the answer is because you cannot get people to believe a take over is “okay” until a city/school has gone bankrupt. Wonder if that is why the new big over reaching government is cutting revenue sharing with local governments and cutting the school aid funding knowing full well it will put many local governments and schools in bankruptcy? People need to get out and VOTE at the next election! Wouldn’t hurt to sign any recall petitions going around either. Recall will probably fail, but it may send a message, hey this isn’t what we voted for!

    Article I, section 10, US Constitution.

    The changes to the EFM law giving these managers the power to terminate contracts is EXPLICITLY forbidden by the Constitution. It does not get any more unconstitutional than that.
