Sup. Court rejects fast track for health care reform challenge

By Ed Brayton | 04.26.11 | 7:13 am

The Supreme Court on Monday rejected a request from Virginia Attorney General Ken Cuccinelli to immediately hear a legal challenge to President Obama’s health care reform bill without allowing the appeals court to hear the case first.

The Supreme Court rejected a call Monday from Virginia’s attorney general to depart from its usual practice and put review of the health care law on a fast track. Instead, judicial review of President Barack Obama’s signature legislation will continue in federal appeals courts…

Only rarely, in wartime or a constitutional crisis, does the court step into a legal fight before the issues are aired in appellate courts. Hearings already are scheduled in May and June in three appeals courts.

The case still could reach the high court in time for a decision by early summer 2012.

Virginia’s case is one of several legal challenges to the law that have been filed. Former Michigan Attorney General Mike Cox joined a case filed by the state of Florida and current AG Bill Schuette has said he will continue that fight.

people need to plug in their brains a little bit. if we have national health care we stand a better chance of curing things like cancer because the goverment would be picking up the bills. drug companies doctors and hospitals are making to much profit in treating cancer to ever want a cure!

Nothing is more important than freedom and liberty, without those it doesn’t matter what your health is like. Patrick Henry once said, “Give me liberty or give me death”. Health care doesn’t do much for you without a free country to live in. Would you rather be healthy and oppressed without freedom and liberty? What sort of life is that? I’d rather take my chances with no health care at all and live a life without the slavery of legislation in an environment of freedom and liberty. The major problem with the health care bill is the individual mandate, because it sets an extremely dangerous precedent opening the door to major government intrusion on our lives, freedoms and liberty. If history tells us anything at all, it tells us that you should never say it can’t happen to me and also that people loose freedoms as a series of steps, with each step clearing the way for the next step. The mandate is one of those steps in the wrong direction. Regarding the comment on cancer, this health care bill doesn’t have much impact on that ability. There are far more effective, intelligent and financially sound methods to going after cancer than what you’ll ever find in this bill. Do you want to be a ward of the state, i.e government, or your own person?
