FBI investigating possible mortgage fraud in Ingham County

Curtis Hertel Jr., Register of Deeds for Ingham County, says that a discovery he made involving alleged fraudulent mortgage documents is now being investigated by both the Ingham County Sheriff’s Department and the FBI.

“Yes, this is, in my opinion, fraud,” Hertel said. “This is a situation where people were forging someone else’s name to a legal document to take another person’s property. That is fraud.”

As Register of Deeds, Hertel is responsible for overseeing all the documentation of property sales in the county, including mortgage assignments. Mortgage assignments are documents that transfer ownership of a mortgage from one lending company to another.

Hertel says he was tipped off to the alleged fraud when he saw a report on CBS’ 60 Minutes. That story helped unwind the Byzantine labyrinth of paper work and investments under which the mortgages were sold as investments. But now that the banks are facing down homeowners who can’t afford the payments of their mortgage agreements, they are finding that in the rush to bundle the mortgages, there were corners cut. The original paperwork is missing.

60 Minutes uncovered a widespread program wherein people were named as vice president of various banking entities. Those people, including Linda Green, signed these documents by the dozens every day. Green, it turned out, was more desperately needed than one person could handle. Therefore people were paid $13 an hour for signing Linda Green’s name.

Green’s name was used on thousands of mortgage assignment documents in the U.S. — including here in Michigan. But in Michigan, foreclosure is simply a matter of advertising the foreclosure plan. In order for a homeowner to stop the process, a home owner would have to file suit in circuit court and receive an injunction to stop the foreclosure process and force the foreclosure agency — usually a company like Republican donor Trott and Trott — to cease the foreclosure until clear title to the property can be established.

Hertel says he identified one case in which a person was in the process of foreclosure, and the alleged fraudulent document was used. That person is preparing to fight the foreclosure with the newly discovered documentation.

Hertel tells Michigan Messenger that he has spoken with registers of deeds from at least half of the state’s 83 counties. Each register told Hertel they found allegedly fraudulent documents. In Hertel’s case, he has already identified 60 such cases in Ingham county and he has barely begun to dig through the thousands of documents being held in his office.

In addition to the investigations by the Ingham County Sheriff’s Department and the FBI,tThe story has also gotten the attention of Michigan State Sen. Steve Bieda. He serves on the Senate Judiciary Committee.

“I will be requesting that the Senate Judiciary Committee conduct an investigation on this,” Bieda tells Michigan Messenger.

    Defend your homes America. The banks passed around the promissory notes to multiple parties, collecting money and fees, using them as collateral, over and over and over. They lost track of the trail and now are making up all the “evidence” to foreclose on your homes.     In every way, including but not limited to foreclosures, I suspecty we have the most “fraudulent” county in America: Marin County, California In every way because it is allowed, and supported in the criminal, civil and especially in the family law courts. So many here know about it, but with all the complaints to the FBI, nothing is ever done about it here. It’s a free for all in the courts….and the richest always get what they want. Make of it what you will.

It’s a free for all in the courts….and the richest always get what they want. Make of it what you will.

    Bank of America did it to me, filing forged documents. I got a Default Judgment and
    sent it to Ken Lewis, CEO giving him opportunity to correct it. What happened? I
    found another fraudulent document “Assignment of Mortgage” to eight people on
    my land, using my name, no mortgage attached. I learned this is Collateralized Debt Obligation (where the bank does not have a mortgage, gets insurance wagering you will default … of course you will since the bank did not loan you any money … and
    the bank can do it over and over again). I am still fighting for my land. A developer
    is on it, tresspassing, claiming he now owns it … he does not. I never deeded my
    land to him or anybody. Problem is nobody regulates the bank or prosecutes the
    fraud. FBI glad to see you are helping investigate. Recorder of Deed – thanks to
    you to. Wish I could say our local one was like you.

      the filing fees are a small reason why MERS was created. The real reason is to hide the fact that these loans were never purchased. Simply assigning a company a mortgage does not give them ownership. buying the note is suppose to happen first than the assigment of mortgage evidencing the debt secured against the property.

    Laid off and unemployed people should be trained to spot foreclosure fraud and start checking over every foreclosure filed before it’s allowed to go to court or proceed with foreclosure and eviction.
    Every county in the nation has been cheated out of filing fees because most of the banks used the MERS system to record sales, deeds and assignment of mortgages instead of going to the records office and paying the fees and filing with the county as required by law.
    Add that up by thousands a month, each filing at about $150 each and you can see why the nation is in deep financial trouble.
    Money owed but never paid.
    Instead of attacking the unions somebody ought to be suing Bank of American, Wells Fargo and any other entity that used MERS to cheat the states.

    they used MERS because the mortgage was never actually purchased dollar for dollar by anyone. The mortgage can be assigned to anyone, but if they do not purchase the note and they securitize the mortgage they both become null in void. If they sent these “so called” recordings to the counties they would never have been allowed to be recorded. But the banks are smart, they create a company(MERS) aka one of the good ol boys and use them to track the assigment of mortgages. The audacity of the banks and lenders to think they dont have to use the county recording system to complete property transactions. This should have been the first red flag.  Capital was infused in these big corporations and promises were made on the backs of the home owners. These companies are foreclosing on homes they do not own. Simply look at the statistics. The non-judicial foreclosure states have foreclosure rates in the double digits. The judicial states are no higher than they have ever been. These lenders and banks know what they are doing is fraud and unless every American fights they will win!

    SunTrust is also in this ring of fire. We had a mod for one year and they told us we were 6 months in arrears, when we had all the docs to prove that we were up to date. One day in June, 2011, we receive a collection letter from their attorneys, then the NEXT day we receive a foreclosure letter, putting the sale for Aug.2, 2011 on the courthouse steps. My only recourse was to file Chapter 13 bk the day before to save the property, which now puts the responsibility on them to show the note to prove they are the owners. It is a MERS mortgage. We have obtained a forensic audit and a securitization audit. We are working with paralegals specializing in this field to obtain a Quiet Title (no mortgage) to our property. Keep up the fight. Don’t sit back and let them STEAL your home, especially in non-judicial states.
