First suit filed over Emergency Manager law

The first lawsuit challenging the constitutionality of the state’s new Emergency Financial Manager law has been filed in federal court by two Detroit city pension boards.

The Detroit News reports:

The city’s two pension funds sued Gov. Rick Snyder and state Treasurer Andy Dillon in federal court today to block part of a new emergency manager statute.

The suit alleges the emergency manager statute is unconstitutional, would modify the City Charter and collective bargaining agreements and allow for the removal of pension fund trustees. The suit also claims the law could potentially allow for the funds to be dissolved and have the assets transferred to another retirement system.

I expect another suit, filed by Benton Harbor officials, will be filed soon.

    They really need to get an injunction, a ruling and a challenge to the law – it needs to be repealed, scaled back, redefined, at best. These measures need to hold cities in a ‘status quo’ and not a takeover chokehold. That is bully. Any court should recognize it.

    This is not democracy. We need a recall on this Gov. or should I say” His Dictatorship”. Anyone have info on a recall?

    Recall Information: go to Michigan Citizens United (dot) org for information on The Recall. Petition language was officially approved in Washtenaw County today. That means between May 8 – July 1, signatures for 866,522 registered voters must be collected and petitions turned in. The website has more information on timelines, process, etc.
