The Ninth Circuit U.S. Court of Appeals has upheld a preliminary injunction against the most controversial parts of the Arizona anti-immigration law that some Michigan legislators want to copy in this state.
The appeals court was divided 2-1 but ruled that the district court judge had not abused her discretion in ordering the state of Arizona not to enforce those provisions being challenged until the completion of the suit filed by the U.S. Department of Justice against the legislation.
This is not a ruling in that case, only on the preliminary injunction, but the language used in the ruling suggested that the judges have strong doubts about the constitutionality of the law. That issue will now be decided by the district court in Arizona. You can read the full ruling here.
