Waters files to withdraw guilty plea

By Ed Brayton | 02.08.11 | 7:54 am

Former state Rep. Mary Waters is asking the 6th Circuit Court of Appeals to allow her to withdraw her guilty plea in a federal corruption trial where she was a co-defendant with her former boyfriend Sam Riddle.

The Detroit News reports:

The appeal argues U.S. District Judge Marianne O. Battani failed to establish a factual basis for Waters’ guilty plea; her Sixth Amendment right to effective legal assistance was violated; and it was unfair to make her guilty plea conditional upon Riddle also pleading guilty, according to the filing.

It’s extremely rare for a court to allow a guilty plea to be withdrawn. This one will be even tougher to win since Waters was the one who asked the court to pay Richard Convertino as her court-appointed attorney.
