Use of National Guard in federal raid raises questions

LANSING — On Nov. 30, the Drug Enforcement Agency raided a facility in Meridian Township. Along with ground forces, the Michigan National Guard provided two Blackhawk helicopters to assist in the operation.

The facility was a joint growing operation by several registered patient caregivers. The caregivers decided to rent the facility to grow medical marijuana for their patients, and remove the drug from their homes.

Dave Clark, an Okemos attorney representing one of the patient caregivers, told the City Pulse that his client and the others had done nothing illegal.

“We were surprised there was even a warrant. Everything inside was legal under state law,” Clark said. “I’m sure it was 100 percent legal.”

Clark and his client were not the only ones surprised by the raid. Meridian Township Police Chief Dave Hall tells Michigan Messenger that his department was never informed of the raid by federal authorities. Traditionally, when a law enforcement agency is going to be engaged in an action in another jurisdiction, they let the law enforcement from that jurisdiction know. This is done to prevent sending officers to the scene of a police action because of 9-1-1 calls.

United States District Attorney Rene Shekmer of the Western District in Grand Rapids told the City Pulse that the raid was conducted at several locations, and agents seized 400 plants, as well as growing equipment.

“Under federal law, there is no exemption for medical marijuana. Under Michigan law, there are limits and rules you have to follow,” Shekmer told the City Pulse. “As a broad brush, it does not appear they were (state-compliant) because of the number of plants.”

Feds are also seeking information from the Michigan Department of Community Health about several medical marijuana caregivers. It is widely believed this subpoena, issued in June, is directed at the caregivers involved in the Meridian Township growing operation.

But that conflict over whether or not the facilities were following Michigan law, also raises the questions about why the Michigan National Guard participated in the operation.

“Our helicopters do not support action in violation of state laws. A warrant authorizing Guard air support was issued for the Meridian Township mission. We supported the mission,” says Angela Simpson, deputy public information officer for the Michigan National Guard.

Simpson says in 2009 Guard assets were used to assist law enforcement in the seizure of 730,000 tablets of ecstasy, 607,865 pounds of illegal drugs (cocaine, heroin, hashish, crystal meth, opium, and others) and 107,480 pounds of marijuana. The counter-drug program’s focus is on prevention, education and apprehension support.

The Blackhawk helicopters, Simpson said, were not armed, nor were National Guard personnel.

Simpson also released an 80 page document from the Secretary of Defense which is the basis for the Guard’s involvement in federal government operations. Under those standing orders, Simpson says, the Guard can assist when presented with a warrant. Civilian leadership is not required to be briefed on those actions, or to approve them.

Those orders also authorize the deployment of Guard units and assets in drug interdiction actions and outline specific rules of engagement including lethal force to protect lives.

Former Gov. Jennifer Granholm’s office said last month that Granholm supported the actions of the National Guard, but declined to answer any specific questions.

Gov. Rick Snyder’s office did not respond to multiple requests for comment on this situation.

The ACLU of Michigan says it is too early to tell if the use of National Guard assets was legal, or if the DEA was right to conduct the raid.

“This situation seems to raise more questions than answers. The federal government has a policy of not enforcing federal marijuana laws where state medical marijuana laws are being followed,” said Dan Korobkin, ACLU of Michigan staff attorney. “However, if a grow operation is being conducted outside of the confines of the MMMA, federal law enforcement may have reason to investigate and act.”

    If citizens are abiding by their state laws then the federal government should not be stepping in. That is not how our country was established, that is big brother government and another step towards Barak Obama’s socialism.

    When will we limit government action and quit spending money on areas that should not be of concern. 2 helicopters! That’s hilarious.

    A/ Being used for intimidation
    B/ A big waste of taxpayer money
    C/ In violation of the mission of the National Guard

    Until THE Federal Government (notice I didn’t say OUR Government) admits their Marijuana Laws were based on groundless propoganda from corporate greed in the days of “Reefer Madness” and they have wasted BILLIONS of dollars in enforcement and destroyed COUNTLESS lives and plundered their property in the process, these rifts will continue between state and federal authorities in states where the value of Medical Marijuana has been recognized. I don’t see the Feds having the collective intelligence, honesty, and integrity to do that anytime soon.

The “Tin soldiers” are the National Guard, and many people, including Young, felt that it was President Richard Nixon’s fault.

    Hello, We are a senior citzen family; most of the patience that these independent caregivers were growing for are over the age of fifty with serious illness such as cancer, brain damage, etc…

    The Meridian Township Police were contacted before any growers were allowed in building. And, offered keys to enter buildings at any time.

    NO STATE LAW WAS BROKE! Even those attempting to make it sound illegal had to say: :by the broad view of the law” as there were four hundred plants. What needs to be understood anything with a root is a plant; so, since the last time plants are checked to next. Yes, some plants can grow roots before they are pulled.

    But, still NO STATE LAW AS BROKE. As, do the math yourself. Seven care givers being investigated times the fact they can each have 100 plants. Hum… last I knew in math that adds up to more than four hundred.

    The Meridian Township officials were contacted to inform them of this growing operation; as if they felt it was illegal; the growing clients would not have been allowed.

    First time heard that National Guard and Helicopters were invoveled.

    The Federal Agents are trying to make a simple legal grower’s building look like it was some big drug bust; it wasnt’. It was obvious on a few faces they were like “what, this is what we are busting?”

    Don’t trust the information given by the Federal agents or gov’t; they are trying to protect themselves from attacking upstanding citizens; who work hard; follow laws and are for the most part over the age of fifty. The Federal Agents need to be careful as to how much they insult or presue this group of individual caregivers as they know they did not break laws. And, the Federal Agents could cause an Michigan riot if they continue to attack these people.

      I am a grandmother over the age of fifty.

      I may be arrested for speaking on her. So, I ask if you hear about a local woman being arrested by the Federal Gov’t please come to my defense.

      As Federal Agents have stated: We are to not talk about this as it is interference to THEIR CASE. My life is “their case”; they can say anything they want about this situation. Yet, if I speak “I can get arrested?”

      I have always defended our American Gov’t. But, my rose colored glasses are off now. I am very sad they are… I love America, I believe in American. My family fought in all the wars; including the Revolutionary war (out of New York). I have Native American blood. I bled RED, WHITE AND BLUE…

      My heart is broke… as we did everything we could to be legal; contacted officials, police; got lawyer ahead of renting or participating in being caregivers. As we wanted to be legal in Michigan.

      This is a fear tactic by the Federal Agents. As, if they can make us run and hide. Then, what business owner will ever rent to anyone who wants to grow outside of their home. What person can feel safe to legal grow as a caregiver?

      Thank you for listening… As I am sure the Federal Agents are listening. But, informed they tap our phones, emails, and facebook, etc… So, if I get arrest to “interfering with their investigation”. Please help this grandma.

    Michigan needs to secede as soon as possible. The USofA takes from us way more than they give. Anytime we figure out a way to stand up on our own the feds come in and knock us back down again.

      I think all the states should secede. This dictatorial federal government is out of control. The empire has gone rogue and frankly it is quite scary when you think about the history of empires; they eventually come to an end. How the US empire will end is not clear but lets all hope it is not by the barrel of guns, tanks and planes of many nations that will finally get fed up with our trigger happy politicians and the military industrial complex!
