Transgender man marries, has marriage revoked in the same day

Jordan Swan, who is a female to male transgender man, says he went to the Oakland County Clerk this week to marry his fiancee. The two paid for their marriage license, swore their oaths and signed on the dotted line. Then they were off to the chapel to get married… or so they thought.

Swan tells Fox 2 News that shortly after the happy couple left the clerk’s office they received a call telling them they had to return to the offices to get a refund for their marriage license fee. The reason they were offered when they got to the offices? Swan is not a man because he doesn’t have a penis.

That had Swan crying foul, and describing the situation as “bulls–t.”

It should be noted that Swan presented a letter from his doctor showing he completed gender reassignment surgery in March. Under Michigan law, that affidavit is enough for Swan to have his gender switched out on his birth certificate.

But for Oakland county officials, under the leadership of Secretary of State-elect Ruth Johnson, the key to the whole matter is having a penis. Penis construction for transgender men, Swan says, costs “thousands and thousands” of dollars, and is something he simply can’t afford right now.

Fox 2 turned to their legal analyst on the issue, and asked — does a penis make a person a man?

“If a doctor signs an affidavit that says you’ve had the sex reassignment, you can take that to the courthouse and you can get a new birth certificate,” explained Fox 2 legal analyst Charlie Langton. “You don’t need a penis to become a man.”

Earlier this year, Oakland County Clerk Ruth Johnson came under fire from LGBT activists after she did an about face on issues impacting the gay community. The move was widely seen as a way to challenge Rep. Paul Scott (R-Grand Blanc) who was gaining steam in the Secretary of State race by vowing not to issue new licenses to transgender people who have completed gender reassignment surgery.

Michigan Messenger reported Johnson, who won the Republican primary and then the November election, had this to say about the issue:

“No I do not support allowing people to change their gender on their license as a result of surgery or lifestyle.”

And now Johnson’s political rhetoric has a face.

Swan says he plans on getting the new birth certificate, and then will be back to the clerk’s office so he can marry the woman he calls “the love of his life.” However, he better hurry, Johnson takes office Saturday and has control over those vital documents.

    Politicians and county clerks are not medical professionals and do not have the training or expertise to determine someones gender identity. If a medical professional has signed off saying he is now male, then he is male. If he identifies himself as male, then he is male. Politicians and clerks are not qualified to make that call and deny fair treatment to anyone.

      This is the inevitable conclusion of the hard right’s ugly meme complex that holds that it doesn’t have to acknowledge the identities and lives of people that it “disagrees with.” Bigotry by ANY name should never be rewarded, and Johnson deserves impeachment, if such is possible in MI.

    You don’t have to be a “medical professional” to know that a woman is not a male. You have to be delusional to believe that a woman is a male. Thanks to Ruth Johnson and others who refuse to put our state govt in the position of officially certifying a delusion.

      Variant neuroanatomy is not a “delusion,” but a fact. What Ruth Johnson does is harming a small and powerless minority to satisfy her own desires.

      richg – and you don’t have to be a scientist to know that the world is flat, as everyone can see, right?

      It’s more complex than you think, I’m afraid. You know that “men have XY chromosomes”, right? Well, over 3 in 1000 don’t. 2 have XXY, 1 has XYY, and some even have XX, or mixes of X and XY, or XY and XX, or …

      These people are Intersexed. Biologically, anatomically, they’re neither wholly stereotypically male nor female. 1 in 60 people qualify, technically, but most don’t know it unless they have a “sex test” for playing competitive sport, or visit a fertility clinic to find out why they can’t seem to have children.

      Transsexuals also have an Intersex condition too. To over-simplify, male brain in otherwise female body, or the reverse. You can see this in autopsy results, and in MRI scans. A matter of Anatomy, not Psychology.

      Even the Psychs know this isn’t a “delusion”, it’s never been classified as one, but as a separate psychiatric condition, as the patients show no signs of being delusional. Now we know it’s an anatomical issue, not a psychiatric issue.

    Full penile reconstruction doesn’t just cost “thousands and thousands”.
    It costs over $100,000.
    It takes a series of a dozen operations, over a number of years.

    It also has a success rate of 30%. Some patients die in the process. They have to pay for it themselves of course, in general medical insurance doesn’t cover it, and it’s not covered by either Medicare nor Obamacare.

    A less complete reconstruction costs $30,000, and has much higher success rate, but that may not be considered complete enough by the politicians, no matter what the doctors say.

    Perhaps we should ask the politicians – how long is it supposed to be to count? What about the many non-transsexual men less generously endowed, are they to have their marriages voided?

    This is sickening. It’s obscene the way that people with a medical issue are being treated by bigots, pandering to the prejudiced.
