Tipton couple sues over early eviction in foreclosure case

A Tipton couple has filed a lawsuit against Fannie Mae and several local contractors, reports the Adrian Telegram.

Gary and Katherine Clark had their home foreclosed by Fannie Mae, and had until June 14 to clear out their belongings. They say that while they were in the process of packing and moving their belongings to a new home, contractors from the Ohio-based Safeguard Properties entered the home and cleared their belongings. The couple still had three days to vacate the foreclosed property.

The couple is seeking nearly $30,000 for property they say contractors removed from the home and either never returned, or returned damaged.

The case is set for trial next year.

Fannie Mae has been served with the lawsuit but had not filed a response as of Monday when the couple was in court to schedule hearings. The contractors did file responses, with Safeguard Properties claiming it was not responsible for the actions of contractors and challenging the value of the missing property. The local contractor, Traditional Enterprises denies it has lost any of the Clarks’ property.

The suit comes as more and more cases of questionable foreclosure practices continue to surface in Michigan and across the nation.
