Shirvell takes leave of absence

It seems the pressure is increasing in the Michigan Attorney General’s office. Andrew Shirvell, the assistant AG who is gaining national attention for his virulently anti-gay attacks an stalker-like behavior toward a U of M student leader, has now taken a “personal” leave of absence.

The ACLU is also backing Cox’s statement that Shirvell’s off-duty speech is protected by the First Amendment.

    See, this is one of those examples about the ACLU that the right-wing loves to ignore: they'll protect anyone and everyone's Constitutional freedoms. Even when it's a conservative who is exercising those freedoms.

    The ACLU has a right to protect his freedoms. However he is in a high profile position and went on CNN to defend a position that would put him at odds with his job. This is a fight they can't, and shouldn't, win. Cox should fire this guy, and do it soon. Problem is, Cox lost the primary, he doesn't care anymore.

    This is not a pure First Amendment matter, either. Shirvell has chosen to practice law, and the bar has ethical requirements to which its members must adhere. I am not a lawyer, but my legal source tells me that S. must not act in ways that bring the profession and the administration of justice into disrepute. If (e.g.) the bar reprimands him (I doubt that this would be a disbarment matter), that would surely bear on his fitness to serve as an assistant A.G.
