Kilpatrick files appeal of probation violation sentence

Attorneys for disgraced former Detroit Mayor Kwame Kilpatrick on Thursday filed an appeal of the sentence — but not the conviction — that he received for violating the terms of his probation. Kilpatrick is currently serving a sentence of 14 months to five years for failing to pay required restitution and hiding his assets from the court.

The Detroit News reports:

Kwame Kilpatrick’s attorney has filed an application to appeal the former mayor’s prison term, claiming a Wayne County judge made numerous errors in handing Kilpatrick a guideline-busting sentence.

Attorney Arnold Reed also has asked for Kilpatrick’s immediate release on bond while the state’s Court of Appeals considers arguments that Judge David Groner violated laws and court procedure on May 25 when he issued a 14-month to five-year sentence for probation violations.

The state guidelines, Reed says, called for a sentence of no more than 17 months. He says Judge Groner did not offer a compelling reason for exceeding those guidelines.
