NTSB: No gag orders or sealed files in oil spill investigation

MARSHALL — Contrary to comments made Friday by Marshall Township Clerk Cynthia Sink, the National Transportation Safety Board lead investigator says there are no gag orders or sealed files in relation to the investigation of the oil spill which dumped more than one million gallons of crude oil into Talmadge Creek and the Kalamazoo River.

Sink told Messenger on Friday that she could not release a copy of the Marshall Township Fire Department incident report relating to the department being called to respond to a smell of natural gas on Sunday July 25 at 11 p.m. because the report was “sealed.”

“I don’t believe that’s true,” Nicholson said. “We have no gag orders on anyone. I think the press has seen some of the same 9-1-1 call logs that we have. So no, that’s not true.”

Nicholson did say that some agencies, such as Enbridge, are what he called parties of the investigation. Those who are parties to the investigation do agree to allow all information to be “managed” by the NTSB. Local fire departments and police agencies are not parties to the investigation.
