With the possibility of disgraced former Detroit Mayor Kwame Kilpatrick being diverted to a boot camp that would cut his sentence down to a mere 90 days hanging in the air, Judge David Groner sent back a letter written by Wayne County Prosecutor Kym Worthy opposing such a diversion, saying that the DA has no role in the decision. The Detroit News reports:
The judge considering whether to allow Kwame Kilpatrick to substantially shorten his prison sentence with a boot camp program returned a letter of objection today from Wayne County Prosecutor Kym Worthy.
Wayne County Circuit Judge David Groner, in rejecting Worthy’s complaint that Detroit’s former mayor shouldn’t be allowed in the state’s Special Alternative Incarceration program, also sent a letter reminding the prosecutor, “This court does not respond to letters involving legal matters pending before this court.”
“It’s improper. It’s called ex parte contact and it’s legally inappropriate,” said Kilpatrick’s attorney Arnold Reed. “Judge Groner did the right thing in this case by rebuffing her communication.”
Still, given how tough Groner was on Kilpatrick during his trial for probation violations it seems highly unlikely that he would grant such a diversion.
