Wayne State honors Damon Keith

To call Damon Keith a Michigan legal giant is to understate the case. The 88-year old judge, who has been on the federal bench for 43 years, was — quite literally — born on the 4th of July. And there’s probably no one in this state’s history who has done more to advance the cause of civil rights and equality more than Keith.

Wayne State University is recognizing that by dedicating a new center in his name, the Detroit News reports:

On Monday, Wayne State University Law School will break ground on the Damon J. Keith Center for Civil Rights. The tribute recognizes the towering stature of the judge, whose landmark rulings over more than 42 years on the federal bench redefined civil rights and civil liberties law.

“The First Amendment is alive and well in no small part because of Judge Keith’s efforts,” said Robert M. Ackerman, dean of Wayne State’s Law School.

That’s hardly an exaggeration. A well deserved honor for one of Michigan’s favorite sons and one of the most well respected judges on the federal bench.

Jocelyn Benson, now a law professor at Wayne State running for Secretary of State this year, was once a clerk for Keith. So was Gov. Jennifer Granholm.

    I have great admiration and respect for Judge Damon Keith. I have thought of him so often over the years and hoping one day to thank him for his decision to clear my brother's name back in 1975 in the United States Federal Court. A small part of justice was served to my family that day. His ruling has been the ONLY answer or positive action we've had regarding my brother's disappearance. My brother, Michael E. Haley, AE3, USN was serving onboard the USS Intrepid at that time. The ship was on a three week cruise to Bermuda from October 20, 1970 to November 7, 1970 and Mike was last accounted for around 0200 on October 23rd, while the ship was in shark infested waters and over 30 miles from the shores of Bermuda.

    The Navy sent an AWOL bulletin to our home in late November,1970, and shortly before Christmas, we received a notification he was a “Deserter.” After one year of writing to the Navy, Congress, the President, the Consulate, etc., and no answers, my family drove to Rhode Island to talk to his friends and find our answers. We found Mike's friend and to our surprise no one was questioned, no one was allowed off the ship as the Intrepid dropped achor offshore and the Intrepid arrived in Bermuda at 8:00 AM, on the morning of October 25, 1970. We also found Mike's duffel bag (without his belongings) that was carried off the ship one year later, and we found his jacket in the Squadron Hanger (it had been hanging there for one year). My family was devastated and we knew all along Mike was dead, something terrible happened to him on that cruise.

    We went home and vowed to clear Mike's name no matter what it took. It was several years later as the Navy continously had our case thrown out. Appeal after appeal until we landed in Judge Damon Keith's Courtroom, one of high Honor, Truth and Honesty. He reviewed our case before him and I will never forget the words when our Attorney called to tell us we won … finally. He said Judge Damon Keith ruled, “No, something is not right here. Something is not right. This young man does not deserve this and his status should be changed from Deserter to either Missing in Action or Deceased.”

    I was only 22 at that time, the same age my brother was missing or killed onboard his ship while serving our country for 3 years. I moved to California in hopes of moving on with my life and leaving the pain and unbearable anguish behind. That pain wouldn't leave though. There has not been a day I haven't thought about what happened to my brother, how did he die, why didn't we get any of his belongings, what happened to his body … and why wasn't any “One” held accountable? Mike's Commanding Officer knew he was dead, yet allowed my family to be mislead from the truth and give us a false sense of hope that Mike was alive. The most devastating anguish any one could do (I know this to be true since I also lost my 7 year old son to cancer. I knew he was dead and buried him, and was able to grieve, we had his body, etc.)

    The only comfort my family had over these past 40 years, was from Judge Damon Keith's remarks written in a court document many years ago. I've thanked him many, many times over the years in my thoughts of gratitude and thanked God for sending him our way that day. He is the most Honorable and respected man of truth and honor I have ever known. We are most grateful for his decision to make a right out of a wrong. Please thank him for his years of service to our Country and for his truth and justice that was served to our family.
    I wish him the best. I am a most grateful little sister.
