Kilpatrick misses payment, judge orders hearing

By Ed Brayton | 02.23.10 | 7:37 am

Disgraced former Detroit Mayor Kwame Kilpatrick missed most of his court-ordered restitution payment over the last few days and the judge in his case has ordered his attorneys to appear in court Tuesday morning. The Detroit News reports that on Friday, Kilpatrick paid $14,048 of the more than $79,000 he was ordered to pay, and on Monday he paid an additional $21,175.

That still leaves him nearly $44,000 short of the payment mandated by the judge a few weeks ago by Wayne Circuit Judge David Groner after the judge found that he had lied to the court and hid significant amounts of income from authorities while falsely claiming poverty. The result could be more legal trouble for Kilpatrick:

Former Mayor Kwame Kilpatrick’s failure to make a $79,011 court-ordered payment on Friday has resulted in the judge ordering his lawyers, the county prosecutor and probation authorities to report to him Tuesday morning.

No warrant has yet been issued accusing Kilpatrick of violating the terms of his probation, and he hasn’t been ordered to travel from Texas to attend Tuesday’s session…

Worthy’s spokeswoman, Assistant Prosecutor Maria Miller, said this morning that she expects the Michigan Department of Corrections to also file a warrant for violation of probation. Worthy on Friday declared Kilpatrick was in violation of his probation and a warrant should be expected soon.

Some legal experts had already predicted that Kilpatrick would end up back in jail soon – if not for the restitution problems then perhaps for new legal troubles. The Detroit News also reported that federal prosecutors are preparing felony bribery, corruption and extortion charges against the former mayor.
