Supreme Court refuses to hear West Michigan casino appeal

The U.S. Supreme Court has turned down an appeal petition in a case involving a proposed Indian casino in the West Michigan community of Gun Lake.  The move effectively ends the legal battle between the Gun Lake Tribe and a group called Michigan Gambling Opposition, which has tried for years to block the building of a new casino in Allegan County.

The 6th Circuit Court of Appeals ruled in favor of the tribe, rejecting arguments from MichGO that challenged the constitutionality of a federal law allowing the Interior Department to acquire tribal lands for the building of casinos. MichGO appealed but the Supreme Court has decided not to hear the appeal. As usual, no comment was made as to why.

The next step is for the Gun Lake Tribe to negotiate a compact with the state governing the division of revenue and to break ground. MichGO has indicated that they will try to stop the compact in the state legislature, but if the state fails to approve a legislature then one can and likely will be imposed by the federal government.
