Meijer/recall case: Judge rules only Sec. of State can investigate

By Eartha Jane Melzer | 04.14.08 | 8:02 am

Efforts by Grand Traverse County Prosecutor Alan Schneider to investigate apparent campaign finance violations by grocery giant Meijer hit an obstacle Friday when Judge Phillip Rogers of the 13th Circuit Court ruled that only the Secretary of State has authority to investigate violations of the Michigan Campaign Finance Act.

In February Meijer admitted that it likely violated the act by funding a recall election in Acme Township, where company plans to build a superstore met resistance from locals. Use of corporate funds in a recall election is a felony in Michigan.

Schneider began an investigation after a lawsuit revealed that Meijer’s law firm, Dickinson Wright, and PR firm, Seyferth Spaulding Tennyson Inc., collaborated to create and fund a front group to recall township officials.

Brian McGillivary of the Traverse City Record-Eagle has provided in-depth coverage of the controversy involving Meijer.
